Vania Elise provides creative direction, visual strategy, brand photography, brand videography, consulting, digital products, educational resources, and AI-assisted creative tools.

Each service is customized based on the information provided by the client and the scope outlined at the time of purchase.

2. Booking & Payment

Payment is required in full at the time of booking unless otherwise agreed upon in writing.

To ensure every client receives a thoughtful, high-touch experience, I intentionally accept a limited number of projects each month.

Booking a service reserves dedicated creative time within my schedule. Your purchase secures your place in my creative queue.

Work will begin once:

Payment has been received.

Any required questionnaires or intake forms have been completed.

3. Creative Queue & Turnaround Times

Estimated turnaround times begin once all required materials have been submitted.

Unless otherwise stated:

Visual Clarity Sprint

Typically delivered within 7–14 business days after your completed questionnaire has been submitted.

Photography, video, and larger creative direction projects will follow the timeline outlined in your individual proposal or agreement.

While every effort is made to meet estimated timelines, delivery dates are estimates only and may occasionally vary due to project complexity, client communication delays, illness, family emergencies, or periods of high demand.

Should a significant delay occur, I will communicate with you as soon as possible.

4. Client Responsibilities

To ensure the best possible experience, you agree to:

Provide accurate and complete information.

Submit all requested materials promptly.

Respond to any clarification requests in a timely manner.

Review deliverables within a reasonable timeframe.

The quality of recommendations and creative direction is directly influenced by the quality and completeness of the information provided.

5. Creative Direction

Creative direction is both strategic and artistic in nature.

All recommendations are based on professional experience, creative judgment, and the information provided by you throughout the process.

Because every business is unique, implementation decisions remain your responsibility.

While every effort is made to provide thoughtful, personalized guidance, no guarantees are made regarding specific business, financial, marketing, or revenue outcomes.

6. Revisions

Unless otherwise stated within the purchased service, your purchase includes one round of reasonable clarification or minor refinement should something have been misunderstood.

Additional revisions, consulting, or expanded project requests may require an additional fee.

7. Refund Policy

Due to the personalized nature of my services and the reservation of dedicated creative time, all purchases are final.

Once your booking has been confirmed, refunds, cancellations, or transfers are not available.

Because each booking reserves one of a limited number of creative openings within my schedule, I am unable to offer refunds if you change your mind or decide not to complete the process.

If unforeseen circumstances on my end prevent me from completing your project, you will be offered either:

a revised delivery timeline, or

a full refund at my discretion.

8. Intellectual Property

All creative direction, moodboards, written recommendations, templates, guides, educational materials, AI tools, prompts, digital products, and other deliverables remain the intellectual property of Vania Elise unless otherwise agreed upon in writing.

Upon purchase, you receive a personal, non-exclusive, non-transferable license to use the materials for your own business.

You may not:

Resell or redistribute any deliverables.

Claim my work as your own.

Reproduce or teach my proprietary methods without written permission.

Share purchased materials with others for commercial use.

9. Photography & Video Licensing

Licensing, commercial usage rights, image delivery, and project-specific terms for photography and video services will be outlined within each individual client agreement.

Where applicable, those agreements supersede these general Terms.

10. Portfolio Rights

Unless otherwise requested in writing before the project begins, I reserve the right to display completed work for portfolio, website, educational, social media, and marketing purposes.

If confidentiality is required due to an upcoming launch or other circumstances, please let me know before work begins so we can discuss appropriate accommodations.

11. Limitation of Liability

To the fullest extent permitted by law, Vania Elise shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of any products, services, recommendations, or deliverables.

You acknowledge that creative direction, strategy, and educational resources are advisory in nature, and all implementation decisions remain your responsibility.

12. Third-Party Platforms

My business utilizes trusted third-party platforms such as Stripe, Flodesk, Tally, Google Workspace, and other software providers to deliver services and process payments.

While I make every effort to use reliable platforms, I am not responsible for interruptions, outages, security issues, or technical failures that occur through third-party services.

By using these services, you also agree to their respective terms and privacy policies.

13. Privacy

Your personal information will be collected and handled in accordance with my Privacy Policy.

I respect the confidentiality of your business and will never intentionally share your information except where required by law or necessary to deliver the services you've purchased.

14. Changes to Services & Pricing

From time to time, services, pricing, deliverables, and policies may be updated to improve the client experience.

Any changes will not affect services already purchased unless mutually agreed upon in writing.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law principles.

Any disputes arising from these Terms shall be resolved within the appropriate courts located in the State of Michigan.
